Privacy Notice for Our Social Media Presence

When you visit our social media pages, certain data about you is processed. In accordance with Art. 13 of the General Data Protection Regulation (GDPR), we would like to inform you below about how we handle your data and the rights available to you as a result.

Data Controller

We, SEAK Software GmbH, operate the following social media pages:

Our contact details can be found in the Legal Notice.

Data Processing by Us

We operate these pages to promote our services and products and to engage with you as a visitor and user of our social media pages.

Data that you provide on our social media pages — such as usernames, comments, videos, images, likes, public messages, etc. — is published by the social media platform and is never processed by us for any other purpose. We reserve the right to delete content where necessary. Where the social media platform provides this functionality, we may share your content on our page and communicate with you via the platform.

If you submit an inquiry to us via a social media platform, we may — depending on the nature of your request — direct you to alternative, more secure communication channels that guarantee confidentiality. You are welcome to contact us at any time using the address or email address listed in the Legal Notice. The choice of communication channel is at your own discretion.

The legal basis for the data processing described above is Art. 6(1)(1)(f) GDPR. The processing is carried out on the basis of our legitimate interest in conducting public relations for our company and maintaining communication with you.

Joint Data Processing

For processing activities on our social media presences, we act as joint controllers together with the respective operator of the social media platform.

Where the platform operator permits, we have entered into the required joint controller agreement in accordance with Art. 26 GDPR.

LinkedIn

The key elements of the joint controller arrangement are outlined in the sections below.

Analytics (Insights)

The social media platforms we use regularly generate analytics (Insights) based on usage data, which contain information about your interactions with our social media page. We have no ability to influence, control, or prevent the generation and provision of these statistics.

We do not make use of any optional analytics features offered by the social media platforms.

We process the information contained in these analytics in accordance with Art. 6(1)(1)(f) GDPR, on the basis of our legitimate interest in evaluating engagement with our social media pages and improving our content to better serve our target audience.

Targeted Advertising

We also use the social media platforms described above to deliver targeted advertising.

To do so, we use audience definitions provided to us by the social media platform operator. We rely exclusively on anonymous audience definitions — meaning we define audience characteristics based on general demographic data, behavior, interests, and connections. The platform operator uses these definitions to serve relevant advertisements to its users. The legal basis for this processing is the consent obtained by the platform operator from its users.

If you wish to withdraw this consent, please use the opt-out mechanisms provided by the platform operator, as that operator is responsible for this processing activity.

We and/or the platform operator may also use publicly available data for audience targeting purposes. The legal basis for such processing is Art. 6(1)(1)(f) GDPR. Our legitimate interest lies in defining the most relevant audience possible. We never use special categories of personal data as defined in Art. 9 and 10 GDPR (such as political opinions or sexual orientation) for audience targeting purposes.

We also use information about visits to or interactions with other websites for audience targeting purposes (known as remarketing). This may involve the use of cookies. In such cases, we obtain prior consent from users via a consent banner on the relevant websites and provide information about the data processing at that point. You may withdraw this consent at any time by accessing the consent banner on the relevant website.

Data Processing by the Social Media Platform Operator

The social media platform operator employs web tracking technologies. This tracking may occur regardless of whether you are logged in or registered with the platform.

We wish to draw your attention to the fact that the platform operator may use and analyze your profile and behavioral data for its own purposes. We have no influence over how the platform operator processes your data. Please keep this in mind when using social media platforms.

For more information about data processing by the platform operator, as well as available privacy settings and options to object to processing, please refer to the platform operator's privacy policy.

Retention Period

We delete your personal data as soon as it is no longer required for the processing purposes described above and provided no statutory retention obligations prevent deletion.

Your Rights as a User

As a user, you have the right — subject to the applicable conditions being met — to exercise the following rights against both us and the social media platform operator:

Right of Access (Art. 15 GDPR)

You have the right to request confirmation as to whether personal data concerning you is being processed. If so, you have the right to access that personal data and to receive the information specified in Art. 15 GDPR.

Right to Rectification and Erasure (Art. 16 and 17 GDPR)

You have the right to request the immediate rectification of any inaccurate personal data concerning you, and, where applicable, the completion of any incomplete personal data. You also have the right to request the immediate erasure of personal data concerning you where one of the grounds set out in Art. 17 GDPR applies — for example, where the data is no longer necessary for the purposes for which it was collected.

Right to Restriction of Processing (Art. 18 GDPR)

You have the right to request the restriction of processing where one of the conditions set out in Art. 18 GDPR is met — for example, if you have objected to processing, for the duration of any related review.

Right to Data Portability (Art. 20 GDPR)

In certain cases as specified in Art. 20 GDPR, you have the right to receive personal data concerning you in a structured, commonly used, and machine-readable format, or to request that this data be transmitted to a third party.

Right to Object (Art. 21 GDPR)

Where data is processed on the basis of our legitimate interests pursuant to Art. 6(1)(1)(f) GDPR, you have the right to object to the processing at any time on grounds relating to your particular situation. We will then cease processing the personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or the processing is necessary for the establishment, exercise, or defense of legal claims.

Where data is processed on the basis of legitimate interests for the purpose of direct marketing, you have a separate right to object at any time without giving any reason. Exercising this right will result in the immediate cessation of processing for direct marketing purposes.

Right to Withdraw Consent (Art. 7 GDPR)

Where the processing of data is based on your consent, you are entitled under Art. 7(3) GDPR to withdraw that consent at any time. Please note that withdrawal of consent applies only to future processing. Any processing that took place prior to the withdrawal is not affected.

Right to Lodge a Complaint with a Supervisory Authority

Under Art. 77 GDPR, you have the right to lodge a complaint with a supervisory authority if you believe that the processing of data concerning you violates data protection law. This right may be exercised in particular with a supervisory authority in the EU member state of your habitual residence, place of work, or the place where the alleged infringement occurred.
